Free Case Evaluation

The cochlear implant defect lawyers at the Flynn Law Firm are offering free, no obligation case evaluations to anyone who has suffered a cochlear implant failure of an Advanced Bionics Clarion, C1.2, CII, or HiRes90K cochlear implant. If you or a loved one has been injured by a defective cochlear implant or have endured a replacement surgery where a new Advanced Bionics device was implanted in place of a prior device, contact the Flynn Law Firm today at 1-866-904-3143.

Currently representing victims

The Flynn Law Firm is currently representing several clients across the country who received defective Advanced Bionics cochlear implants between 1999 and 2006. Before contacting the Flynn Law Firm many of the implant recipients were unaware that they had a defective cochlear implant. In many instances, the patient has been told by Advanced Bionics or their audiologist that there is nothing defective about the cochlear implant. Incredibly, in some instances patients are told by Advanced Bionics that the failure of the device was the patient’s fault. The failure of the device has nothing to do with the patient——Advanced Bionics cochlear implants are defective, and as a result of the defects, they fail.

Counseling clients on next step solutions

We have informed our clients about the need for additional surgeries (to remove the defective device and implant a new device) and the availability of remedies to eliminate cochlear implant complications. We are also assisting out clients in filing lawsuits against Advanced Bionics for knowingly putting defective cochlear implants on the market without adequate testing. We are finally working with our clients on how to handle the unthinkable: you do not want a replacement Advanced Bionics device and want a competitor device, such as from Cochlear Corporation. Advanced Bionics refuses to pay for the replacement device, and you lack funds to make the switch. Instead of being extorted by a company into returning to their product line, call us today for help.

Experienced attorneys committed to getting full compensation

The Flynn Law Firm has the experience and resources necessary to ensure that its clients will receive a full and fair recovery through settlement or trial. We are committed to getting full compensation for victims of the defective Advance Bionics cochlear implant to compensate them for their medical expenses, years of pain, additional (and in some cases permanent) hearing loss, and other complications which arise as a result of these dangerous devices, including dizziness, facial paralysis, and significant amounts of pain and suffering for both the user and in some cases, the parents of the patient.
If you or a family member has been harmed by an Advanced Bionics cochlear implant call us at 1-866-904-3143 for a free, no obligation case review.

COCHLEAR IMPLANT ON MY BROTHER -- A FAILURE?

My brother's hearing impairment, which started in his youth, gradually worsened and is now irreversible.  In time, he will totally lose his hearing and will be completely deaf.  The only hope for him to be able to hear without hearing aids is a cochlear implant.  After a seemingly eternal wait, he finally received the implant.  Unfortunately, the device produced an unbearably loud noise (high pitch, robotic sounds) with no words. He had to detach the device because he could not tolerate the pain and jolting sensation in his head. The doctors said "It's normal" and that he should be patient. A day after the external device was installed, he received a FedEx letter from Advanced Bionics announcing a recall of the product (see below). There is also a lawsuit pending against Advanced Bionics regarding the cochlear implant.

Now we wait for the doctor to return to work to advise my brother what to do.

Advanced Bionics Announces Voluntary Recall of the HiRes 90K Cochlear Implant

November 23, 2010
Device will be Recalled from the Market while the Company Works with the US Food & Drug Administration to Address the Issue
Valencia, CA, November 23, 2010 – Advanced Bionics (AB), a global leader in developing advanced cochlear implant systems, announced today that it has notified the US Food & Drug Administration (FDA) that it will voluntarily recall its HiRes 90K cochlear implant device and is retrieving all unimplanted devices in distribution. This action is being taken in response to two confirmed instances where the product experienced a malfunction requiring explantation. These recipients experienced severe pain, overly loud sounds and/or shocking sensations at 8-10 days after initial activation of their device.

AB is continuing to evaluate the root cause(s) of the problem and is working closely with the FDA to address their questions and concerns, and institute changes to the product to ensure that the HiRes 90K has the highest quality for patients who use the device. This
voluntary action is being taken to ensure continued patient safety and product quality.  The risk of any significant adverse medical events appears to be remote at present.
